Almasryia v. Kuwait Dissenting Opinion on the Respondent Application under Rule 41(5) of the ICSID Arbitration Rules holds the respondent has not satisfied the applicable standard of proof in respect of its objections under Rule 41(5) – i.e., that of manifest lack of legal merit

It is entered correctly on legacy.  The correct UIN is IC/0484/02.


On app.islg SN it appears twice.
Once under the correct UIN, IC/0484/02.
And the other entry appears under the wrong UIN, IC/0171/02.  However, if you click "Edit", the correct UIN is entered.

Kuwait Dissenting Opinion on the Respondent Application under Rule 41(5) of the ICSID Arbitration Rules notes the award does not comply with due process requirements in connection with the representation of the claimant in dealings with the Kuwaiti authorities and finds the respondent’s objection has to be dismissed as it fails to demonstrate that, obviously, the notice of dispute would be a mandatory consultation mechanism, that consultations would not be futile, and that the claimant is not validly represented by its joint venture partner
